1. Who we are

Boreas Tunnelling is a division of Boreas Maritime B.V. Boreas Maritime B.V., Kolk 42, 4241 TJ Arkel, The Netherlands, is responsible for the personal data it processes in connection with its Boreas Tunnelling website, recruitment, staffing and employment activities. This statement is intended for website visitors, candidates, seafarers, employees and business contacts. Where another Boreas entity is responsible for a particular service or employment relationship, that entity must be identified in the relevant agreement or privacy information.

2. Contact and your rights

For privacy questions or requests, email team@boreasmaritime.com or write to the Operations team at the address above. Depending on the circumstances, you may request access, correction, deletion, restriction or transfer of your data, or object to processing based on legitimate interests. You may object to direct marketing at any time. Where we rely on consent, you can withdraw it without affecting earlier lawful processing.

We normally respond within one month and without charge. For a complex request, the GDPR may allow up to two additional months; we will explain an extension within the first month. We may request proportionate information to verify your identity. If we cannot fulfil a request, we will explain why. You may complain to the Dutch Autoriteit Persoonsgegevens at www.autoriteitpersoonsgegevens.nl or another competent supervisory authority.

3. Information we handle

Depending on your relationship with us, information may include your name and contact details; correspondence; your CV, work experience, qualifications, certificates and availability; information necessary for an assignment or employment relationship; and relevant website and cookie information. Identity, payment or legally required employment information is only needed at the appropriate stage and for a specific purpose. Please do not send unnecessary medical, criminal-record or other sensitive information in a general enquiry or application.

4. Why we use information

Enquiries and business contact: to answer messages and manage professional relationships. The basis is taking steps you request before a contract, performing a contract where applicable, or our legitimate interest in responding to enquiries and maintaining business contact.

Recruitment and crewing: to assess your application, discuss suitable roles and organise a requested assignment. The basis is taking requested pre-contractual steps or performing a contract where applicable. Other recruitment activities require a separately assessed legitimate interest or consent, depending on the circumstances. Consent to retain an unsuccessful application for future opportunities is separate from handling the current application.

Employment administration: to manage the employment relationship and meet relevant legal obligations. The applicable basis is contractual necessity or the specific legal obligation. Sensitive information requires additional legal conditions; a general employment relationship is not sufficient by itself.

Vacancy updates and other optional communications: consent where required. You can unsubscribe or contact us to stop these communications. Website security and operation: our legitimate interest in maintaining a secure, functioning website. Cookies and similar technologies are subject to the separate rules explained in our Cookie Policy.

5. Sources and required information

We receive information from you through applications, messages, forms and our dealings with you. Where relevant, information may also come from authorised recruitment contacts, references or professional sources. If we obtain your data indirectly, we will provide the information required by the GDPR, including the source and categories of data, unless a specific legal exception applies. We will explain when information is required by law or necessary for a contract; without necessary information, we may be unable to process an application or arrange an assignment.

6. Systems and recipients

We use Wix for the website, Outlook for communication and Invu for candidate and personnel administration. Relevant information may be accessed by authorised staff and service providers supporting these functions. Providers acting on our instructions are subject to appropriate data-processing arrangements.

We share relevant information with our offices in Croatia, Bulgaria and Indonesia for the applicable recruitment, crewing or employment purpose. We have agreements with these offices. We may also need to provide relevant information to the client involved in your proposed assignment, professional advisers or competent authorities where necessary and lawfully justified. Only information needed for the relevant purpose should be shared.

7. International processing

Croatia and Bulgaria are in the European Economic Area (EEA); Indonesia is outside it. Our technology providers may also process information internationally. Data is therefore not represented as being stored exclusively in the Netherlands. Any transfer outside the EEA must meet the GDPR’s international-transfer requirements, using an applicable adequacy decision or appropriate safeguards, with additional measures where necessary. You may contact us for information about the safeguards applicable to your data and how to obtain a copy.

8. How long information is kept

Personnel files: the stated retention period is five years after employment ends, insofar as the particular records remain necessary for employment administration, obligations or legal claims. Information no longer needed must be deleted earlier. Where a statutory retention period applies, that period takes precedence; the five-year period does not replace category-specific legal duties.

Unsuccessful applications: normally deleted within four weeks after the procedure ends. With your permission, we may keep your details for future opportunities for up to one year, after which permission must be renewed or the data deleted. This is separate from an active recruitment or crewing relationship, for which information is retained only while needed for the agreed service and any applicable legal obligations.

Enquiries and business correspondence: retained for the time needed to handle the matter and any related contractual or legal obligations. Subscription information: used while the subscription is active; limited records may be retained where needed to demonstrate consent or honour an objection. Cookie duration depends on the individual cookie and the actual website configuration. Legal claims or statutory requirements may justify retaining limited information longer.

9. Security and automated decisions

Appropriate organisational and technical measures must be used to protect personal data, with access limited to authorised people who need it for their work. No transmission or storage method can be guaranteed completely secure. If solely automated decisions with legal or similarly significant effects are used, the specific processing must be explained and the applicable safeguards and rights provided. This statement does not authorise such decision-making by itself.

10. Changes and related information

We may update this statement when our activities or legal requirements change. The date above identifies the latest revision. Please also read the Cookie Policy and Code of Conduct Processing Personal Data, available through the website footer.
